HARWOOD SKI BIKES
TERMS OF SERVICE
Effective Date: January 4, 2026
These Terms of Service (“Terms”) govern all bookings, rentals, deliveries, pick-ups, and use of equipment provided by Harwood Ski Bikes (“Harwood Ski Bikes,” “Harwood,” “Company,” “we,” “us,” or “our”). By booking, renting, receiving, or using equipment from the Company, you (“Customer,” “Renter,” “you,” or “your”) agree to be legally bound by these Terms.
1. DEFINITIONS

Company: Harwood Ski Bikes, including its owners, officers, members, managers, employees, contractors, agents, affiliates, successors, assigns, and insurers.

Renter: The individual using the rented Equipment. If under eighteen (18), the Renter’s parent or legal guardian.

Equipment: Includes, but is not limited to any snow sliding devices, ski bikes, snow bikes, ski trikes, snow trikes, skis, boots, bindings, helmets, leashes, and related accessories.
-
Activities: Equipment rental, fitting, transport, delivery, pick-up, instruction, demonstration, chairlift use, riding, route or trails suggestions and participation in winter mountain sports.
2. ELIGIBILITY & BOOKINGS
-
All rentals must be booked through the Company’s website using the approved booking application.
-
The individual completing the booking must be at least 18 years old and legally capable of entering into a binding contract.
-
The booking customer is financially and legally responsible for the Equipment for the entire rental period.
- Availability of rental inventory is granted on a first come first serve basis. Memberships and punch pass purchases do not guarantee the right to inventory without a reservation or booking.
3. WAIVER & ASSUMPTION OF RISK (MANDATORY)
-
All individuals who use or ride the Equipment must execute a Release of Liability, Assumption of Risk, and Indemnity Waiver prior to use.
-
Equipment will not be released until all required waivers are completed.
-
Ski biking and related winter sports are inherently hazardous activities involving known and unknown risks, including serious injury or death.
-
By participating in the Activities, the Renter knowingly and voluntarily assumes all risks, inherent or otherwise, including risks arising from the negligence of others.
4. NON-TRANSFERABLE RENTALS (STRICT)
-
All rentals are strictly non-transferable.
-
Only individuals listed on the booking and waiver may use the Equipment.
-
Allowing any third party—including friends, family members, or bystanders—to ride, test, try, or use the Equipment is expressly prohibited.

Unauthorized use constitutes a material breach of these Terms and the waiver and immediately:

Voids all liability protections
-
Shifts full responsibility and liability to the booking customer
-

The Company reserves the right to terminate the rental immediately without refund.
5. CUSTOMER RESPONSIBILITIES & SAFETY OBLIGATIONS
The Renter agrees that they:

Have received instruction and understand how to properly use the Equipment
-
Will inspect the Equipment before each use
-
Will immediately stop using the Equipment and notify the Company if it appears unsafe, damaged, or malfunctioning
-
Will not alter, adjust, repair, or modify the Equipment
-
Will follow all resort rules, posted signage, and applicable laws
-
Are physically capable of participating in the Activities
Continued use of Equipment after identifying a safety concern is done at the Renter’s own risk.
5a. Renter Eligibility, Safety Requirements & Conditions of Use
As a condition of renting Equipment and participating in the Activities, each Renter expressly represents, warrants, and agrees to the following:
A. Assumption of Risk
-
The Renter acknowledges that ski biking and winter snow sports are inherently dangerous activities involving known and unknown risks, including serious injury or death.

The Renter voluntarily accepts and assumes all inherent risks associated with participation.
B. Communication & Emergency Preparedness
-
The Renter must carry a working mobile phone capable of placing calls or sending messages during the rental period.
-
The Renter agrees to use ski patrol or resort emergency services as the primary source of first aid or emergency medical response while on the mountain.
-
Harwood Ski Bikes is not an emergency responder.
C. Required Footwear
-
The Renter must wear rugged winter boots or snowboard boots approved for snow sports use.
-
Prohibited footwear includes:
-
Ski boots
-
Sneakers or athletic shoes
-
Open-toed footwear
-
Any footwear deemed unsafe or incompatible by the Company
-
-
The Company reserves the right to deny use or terminate the rental without refund if improper footwear is used.
D. Physical Ability & Rider Eligibility
The Renter represents that they:

Are at least twelve (12) years of age
-
Are at least five (5) feet tall
-
Are able to lift and maneuver at least fifty (50) pounds
-
Are able to walk unassisted on snow and uneven terrain
-
Are physically capable of safely participating in the Activities
Failure to meet these requirements constitutes a material breach of the rental agreement.
E. Equipment Inspection & Ongoing Responsibility
-
The Renter is responsible for the ongoing inspection and care of the Equipment during the rental period.

Before each use, the Renter agrees to check for:
-
Loose, missing, or damaged bolts or components
-
Abnormal movement, noise, or malfunction
-
-
If any issue is identified, the Renter must immediately stop using the Equipment and notify Harwood Ski Bikes.
-
Continued use after discovering a defect or safety concern is done entirely at the Renter’s own risk.
F. Right to Refuse or Terminate Rental
-
Harwood Ski Bikes reserves the right to refuse, suspend, or terminate any rental—without refund—if the Company determines, in its sole discretion, that:
-
Safety requirements are not met
-
Equipment is being misused
-
Eligibility criteria are not satisfied
-
6. EQUIPMENT CONDITION, DAMAGE & LOSS
-
Equipment is provided “AS IS” and “WITH ALL FAULTS,” WITHOUT WARRANTIES, express or implied.
-
The Renter is responsible for returning Equipment clean and undamaged by the agreed time.
-
The Renter is financially responsible for:
-
Loss, theft, or damage beyond normal wear and tear
-
Cleaning, repair, or replacement at full retail value
-
Additional rental time caused by late return
-
-
The Company may charge the payment method on file as permitted by law.
7. DELIVERY, PICK-UP & NO-SHOWS
-
Delivery and pick-up times selected at checkout are firm, time-based service appointments.
-
Missed delivery or pick-up windows are considered customer no-shows.
-
No-shows and abandoned bookings are non-refundable and charged at the full rental rate.
-
Rescheduling or cancellation requests must comply with the Company’s published delivery and cancellation policies.
8. WEATHER & RESORT OPERATIONS
-
Rentals are not refundable due to weather conditions, snow quality, lift operations, or resort closures.
-
These conditions are outside the Company’s control and are assumed risks of participation.
9. PAYMENT AUTHORIZATION
By completing a booking, the Renter authorizes the Company to charge the payment method on file for:

Rental fees
-
Damage, loss, or cleaning fees
-
Late return charges
-
No-show or policy-violation charges
All payments are processed through Shopify’s secure payment system.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by Utah law, the Company shall not be liable for any personal injury, death, property damage, or loss arising from:

Participation in the Activities
-
Use or misuse of the Equipment
-
Inherent risks of winter sports
Any liability, if imposed by law, shall be limited to the amount paid for the rental.
11. INDEMNIFICATION
The Renter agrees to defend, indemnify, and hold harmless the Company from any and all claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising from:

Renter’s participation in the Activities
-
Use or misuse of the Equipment
-
Breach of these Terms
-
Unauthorized third-party use of the Equipment
12. MEDIA RELEASE
The Renter grants the Company the irrevocable right to use photographs, video, audio, name, and likeness taken before, during, or after the Activities for lawful business and promotional purposes without compensation.
13. GOVERNING LAW & VENUE
These Terms shall be governed by and interpreted under the laws of the State of Utah, without regard to conflict-of-law principles.
Exclusive jurisdiction and venue shall lie in the state or federal courts located in Utah.
14. MODIFICATIONS & SEVERABILITY

The Company reserves the right to modify these Terms at any time.

If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.
